Terms of Service

1. Acceptance of Terms

By installing, accessing, or using MeowPitch (the "Service") — including the Chrome browser extension and the MeowPitch web application at meowpitch.com — you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree with any part of these Terms, you must not use the Service. These Terms apply to all users, including free-plan and paid-plan subscribers.

2. Description of Service

MeowPitch is an AI-powered B2B sales research assistant provided as a Chrome browser extension and web application. The Service includes but is not limited to:

• Automated prospect research and AI-generated outreach suggestions.
• Email composition assistance using AI templates.
• Optional Gmail integration to send tracked outreach emails directly from your Gmail account via the Gmail API.
• Email engagement tracking (opens and replies) for emails sent through MeowPitch with tracking enabled.
• AI-generated insights and sentiment analysis on tracked message outcomes.

Features may vary by subscription plan. We reserve the right to modify, add, or remove features with or without prior notice.

3. User Accounts

You must be at least 18 years old and have the legal capacity to enter into contracts to create an account. When you create an account you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your information to keep it accurate.
• Keep your login credentials secure and confidential.
• Be responsible for all activities that occur under your account.
• Notify us immediately at help.meowpitch@gmail.com of any unauthorized access to your account.

We may suspend or terminate accounts that we reasonably believe have been compromised or are being used fraudulently.

4. Gmail Integration and Google API Usage

MeowPitch offers an optional Gmail integration that, when connected, uses the following Google OAuth 2.0 scopes on your behalf:

• gmail.send: To send emails from your Gmail account when you click "Send via MeowPitch". You initiate every send action; MeowPitch does not send emails automatically without your explicit action.
• gmail.readonly: To check your Gmail history for replies to tracked emails you have sent, so we can record reply events in your MeowPitch dashboard.
• gmail.modify: To register a Gmail Push Notification (Google Cloud Pub/Sub) that alerts us in real time when new messages arrive, enabling timely reply detection.

By connecting Gmail you authorize MeowPitch to access your Gmail account as described above. You may revoke this access at any time via Google Account Permissions or by contacting us. Revoking access disables send, tracking, and reply-detection features but does not delete your MeowPitch account.

MeowPitch's use of Gmail data is strictly limited to providing these features. We do not read, store, or process email body content. We do not share Gmail data with third parties except as necessary to operate the Service (see our Privacy Policy).

5. Email Tracking Disclosure

When you send an email via MeowPitch with open tracking enabled, we insert a small transparent tracking pixel into the email body. This pixel allows us to record when the recipient opens the email. By using the tracking feature, you represent and warrant that:

• You have the right to send tracking pixels to the recipients you contact.
• Your use of tracking complies with all applicable laws and regulations in your jurisdiction, including CAN-SPAM, GDPR, CASL, and any other applicable privacy or anti-spam laws.
• You will not use tracking to harass, stalk, or engage in any conduct that would violate the rights of recipients.

Tracking is opt-in only — it is disabled by default and must be explicitly enabled for each email you send through MeowPitch. MeowPitch is not responsible for any claims arising from your use of the tracking feature.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, national, or international laws or regulations.
• Send spam, unsolicited messages, or bulk communications in violation of anti-spam laws.
• Harass, threaten, defame, or otherwise harm any individual or organization.
• Infringe upon intellectual property rights of third parties.
• Attempt to gain unauthorized access to any system, network, or account.
• Reverse engineer, decompile, or attempt to extract source code from any part of the Service.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Use the Service to build a product that competes with MeowPitch.
• Misrepresent your identity or impersonate any person or entity.

Violation of this section may result in immediate suspension or termination of your account without refund.

7. Subscriptions and Billing

MeowPitch offers a free plan with limited features and paid subscription plans with expanded capabilities. By subscribing to a paid plan:

• You authorize us to charge the payment method you provide via our payment processor (Stripe) on a recurring basis (monthly or annually, as selected).
• Subscription fees are charged in advance at the start of each billing period.
• Prices are stated in USD and are exclusive of taxes, which you are responsible for paying where applicable.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for the unused portion of a paid period.
• We reserve the right to change subscription prices with at least 14 days advance notice. Continued use of the Service after the notice period constitutes acceptance of the new price.

Billing is managed through Stripe. MeowPitch does not store your payment card details. Stripe's own Privacy Policy and Terms of Service govern payment processing.

8. Chrome Extension

The MeowPitch Chrome extension is distributed through the Chrome Web Store and is subject to the Chrome Web Store Developer Program Policies . The extension runs content scripts on Gmail (mail.google.com) and LinkedIn pages solely to provide the features described in Section 2. We do not inject scripts on any other domains and we do not collect browsing data on unrelated sites.

9. Intellectual Property

All content, features, functionality, branding, trademarks, and trade dress associated with MeowPitch — including but not limited to the MeowPitch name, logo, extension code, and AI models — are owned by MeowPitch and protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your own internal business purposes in accordance with these Terms. No other rights are granted.

Content you create using the Service (e.g., email drafts, research notes) remains yours. By using the Service, you grant MeowPitch a limited license to process your content solely to provide the Service.

10. Third-Party Services

The Service integrates with or relies on third-party services. These services have their own terms and privacy policies, which you should review. MeowPitch is not responsible for the content, availability, accuracy, or practices of third-party services.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement. We do not warrant that:

• The Service will be uninterrupted, error-free, or completely secure.
• AI-generated research or email templates will be accurate, complete, or suitable for any particular purpose.
• Email tracking events (opens, replies) will be 100% accurate, as some email clients block tracking pixels or change message threading.

12. Limitation of Liability

To the maximum extent permitted by applicable law, MeowPitch and its founders, employees, and contractors shall not be liable for any indirect, incidental, special, exemplary, consequential, or punitive damages — including loss of profits, revenue, data, goodwill, or business opportunities — arising from or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to MeowPitch in the 12 months preceding the claim, or USD $100 if you have not made any payments.

13. Indemnification

You agree to indemnify, defend, and hold harmless MeowPitch and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your use of the Service or breach of these Terms.
• Your violation of any applicable law or the rights of any third party.
• Emails you send using the Gmail integration, including any claims related to unsolicited email or tracking pixels.

14. Termination

Either party may terminate these Terms at any time. You may delete your account by contacting help.meowpitch@gmail.com. We may suspend or terminate your access to the Service immediately and without prior notice if:

• You breach these Terms or our Privacy Policy.
• We are required to do so by law.
• We discontinue the Service.

Upon termination, your license to use the Service is revoked. Sections 9 (Intellectual Property), 11, 12, 13, and 15 survive termination.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Brazil, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved after 30 days, disputes shall be submitted to the courts of competent jurisdiction in Brazil.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date and, where required by law, provide notice via the extension interface or email. Your continued use of the Service following the effective date of updated Terms constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

17. General

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and MeowPitch regarding the Service and supersede all prior agreements.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
• Assignment: You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
